Agreement to Legal Terms

We, IQAir (China) Sales and Service Co., Ltd. (hereinafter referred to as the "Company", "we", "us", or "our"), are a limited liability company duly established under the laws of the People's Republic of China, with Unified Social Credit Code: 91110105MA004WEY30, and registered address at: Unit D01-0-1305B, 13/F, Building 5, No. 19 Dongfang East Road, Chaoyang District, Beijing, China.

We operate this website https://www.iqair.cn/ (hereinafter referred to as the "Website") and all other related products and services that reference or link to these Terms of Use (collectively, the "Services"). The Website and the Services are primarily directed to users within the territory of the People's Republic of China (for the purpose of these Terms only, excluding the Hong Kong Special Administrative Region, the Macao Special Administrative Region, and Taiwan Region).

These Terms of Use constitute a legally binding agreement between you (whether as an individual or on behalf of an entity, hereinafter referred to as "you") and the Company regarding your access to and use of the Services. By using the Services, you acknowledge that you have read, understood, and agree to be bound by all of these Terms of Use. We expressly state that if you do not agree to any part of these Terms of Use, you must immediately cease using the Services.

We may from time to time post supplemental terms or documents on the Services, or amend or modify these Terms of Use (collectively, "Modifications"). If any Modification occurs, we will notify you in advance by posting an announcement or public notice on the Website. Upon expiry of the announcement or notice period, such Modification shall take effect and become an integral part of these Terms of Use. If you do not agree to the modified terms, you must cease using the Services before the Modification takes effect. If you continue to use the Services after the modified Terms take effect, you will be deemed to have accepted such Modifications. We specifically remind you to periodically review these Terms of Use for any updates.

The Services are available only to users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Services. If you are a minor, you must inform your legal guardian, and your legal guardian must read and agree to these Terms before you may register and use the Services.

We recommend that you print or save a copy of these Terms of Use for future reference.

1. Our Services

The information provided through the Services is intended for access and use only within the territory of the People's Republic of China. If you choose to access or use the Services outside China, you do so at your own risk and are responsible for compliance with applicable local laws and regulations. We make no representation that the Services are appropriate or lawful outside China.

Access to or use of the Services must comply with applicable laws, including but not limited to the Cybersecurity Law, the Personal Information Protection Law, etc. If you cannot ensure compliance with applicable laws, you shall not use the Services. If you use the Services in any manner that violates the laws of the People's Republic of China, you shall bear the corresponding legal liability.

2. Intellectual Property Rights

Our Intellectual Property Rights

Unless otherwise stated, we are the owner or lawful licensee of all intellectual property rights in the Services (including but not limited to all source code, databases, functionality, software, website designs, audio, video, text, photographs, graphics, etc., collectively referred to as "Content") and the trademarks, service marks, and logos contained therein (collectively referred to as "Marks"). Our Content and Marks are protected by the copyright law, trademark law, anti-unfair competition law of the People's Republic of China, as well as intellectual property laws and international treaties of other relevant countries.

The above Content and Marks are provided by us "as is" in connection with the Services, solely for use in connection with the products and services you have purchased.

Your Use of the Services

Subject to your compliance with these Terms of Use (including the "Prohibited Activities" section below), we grant you a non‑exclusive, non‑transferable, revocable license to:

access the Services; and
download or print any part of the Content to which you have been granted access, but only for purposes related to your purchase and use as a user or prospective user.

Except as otherwise provided in these Terms of Use, you may not, without our prior written consent, copy, reproduce, compile, republish, upload, post, publicly display, encode, translate, transmit, distribute, sell, license, or otherwise exploit any part of the Services, any Content, or any Marks for any purpose.

If you wish to use the Services, Content, or Marks in a manner not expressly permitted by these Terms of Use, please contact us through the contact channels published on the Website. If we agree to permit you to post, reproduce, or publicly display any part of our Services or Content, you must identify us as the owner or licensor of such Services, Content, or Marks, and ensure that any copyright or proprietary notices are visible when posted, reproduced, or displayed.

Except for the rights expressly granted to you under these Terms of Use, we reserve all other rights. Any violation by you of the intellectual property provisions constitutes a material breach of these Terms of Use, and your right to use the Services will be terminated immediately.

Your Submissions

The Services may allow users to submit, upload, post, transmit, or otherwise provide photographs, images, text, descriptions, weather observations, location information, and other materials related to current or recent weather conditions (collectively, "Submissions").

You are solely responsible for any Submissions you provide. Submissions are provided by users, not by us. We do not endorse, verify, warrant, or assume responsibility for the accuracy, completeness, timeliness, reliability, legality, security, or usefulness of any Submissions. You should not rely on Submissions as a substitute for official weather alerts, emergency information, public safety instructions, or other authoritative sources. To the maximum extent permitted by law, we disclaim any liability arising out of or in connection with user Submissions; if we are held liable as a result thereof, we reserve the right to notify you and hold you accountable.

License

When you submit, upload, post, or otherwise provide or submit Submissions to the Services, you simultaneously grant to us and our affiliates a worldwide, non‑exclusive, transferable, sub‑licensable, royalty‑free right and license to use, host, store, reproduce, adapt, modify, edit, clip, translate, create derivative works, publicly perform, publicly display, distribute, transmit, and otherwise exploit your Submissions in any media, format, channel, or technology now known or hereafter developed, for purposes of operating, improving, promoting the Services and related products. The term of the foregoing license shall be the period during which your Submissions remain on the Services. After you actively delete your Submissions or cancel your account, we will delete such Submissions within a reasonable period of time, provided that your deletion or withdrawal shall not have retroactive effect on our use that has already occurred, unless otherwise provided by laws and regulations or agreed by the parties.

If your Submissions contain identifying information such as your name, username, display name, portrait, voice, image, biographical information, etc., we will anonymize your personal information and use it only within the scope of display scenarios and purposes consistent with the content you submitted, and we will not use your identifying information for commercial advertising endorsement or otherwise imply your endorsement of our products or services. If we need to use your identifying information beyond the foregoing scope, we will obtain your separate consent.

You acknowledge and confirm that your Submissions are made voluntarily and that we will not pay you any remuneration for our use of the Submissions in accordance with these Terms. However, if our use of your Submissions generates commercial benefits beyond the scope of these Terms, the parties shall negotiate separately.

Retention of Your Rights

You have the right at any time, through the contact channels published on the Website or through your account settings, to request deletion of Submissions you have provided or withdrawal of authorization for such Submissions. Upon receiving your request, we will cease displaying and using the relevant Submissions within a reasonable period required by laws and regulations, except in the following circumstances (and you agree that we shall be exempt from liability): (1) the relevant Submissions have been forwarded, saved, or independently used by other users, and we have made reasonable efforts to assist you but are unable to completely eliminate them; (2) laws and regulations require us to retain the relevant content; or (3) retention is reasonably necessary to address potential disputes or legal proceedings.

Your rights under the Personal Information Protection Law of the People's Republic of China, including the right to know, the right to decide, the right to access, the right to copy, the right to correction, the right to deletion, and the right to withdraw consent to personal information processing, are not limited by any provision of these Terms.

You represent and warrant that:

you own or have obtained all rights, licenses, and consents necessary to submit the Submissions and to grant the rights described in these Terms;
the Submissions are original to you or you have lawful rights to them;
the Submissions do not infringe any third party’s intellectual property rights, privacy rights, portrait rights, contractual rights, moral rights, or other rights;
the Submissions do not contain confidential, private, or personal information that requires the consent of others and has not obtained such consent;
the Submissions do not contain unlawful, defamatory, harassing, hateful, obscene, threatening, misleading, fraudulent, or otherwise inappropriate content;
the Submissions do not contain malware, spyware, or other harmful programs;
any environmental observations, descriptions, or related statements are submitted in good faith and are not false or misleading.

Location Information

If you submit location information, you authorize us to collect, use, display, and publish such location information and associate it with your Submissions. To protect your privacy, please do not submit your precise location, home address, or other information that may identify you or others' personal information. We may, in our discretion, edit, generalize, or delete location information.

Content Review and Removal

We may, but are not obligated to, review, edit, refuse to post, delete, or disable access to Submissions at any time. We do not guarantee that any Submission will be posted or remain visible.

Safety Disclaimer

Please do not create or submit content that may endanger your or others' safety. We are not responsible for any injury, loss, or damage caused by your creation or submission of content.

3. User Representations and Warranties

By using the Services, you represent and warrant that:

all registration information you submit is true, accurate, current, and complete;
you will promptly update your registration information;
you have full legal capacity and agree to comply with these Terms of Use;
you are not a minor in your jurisdiction;
you will not access the Services through automated means (such as bots, scripts, etc.);
you will not use the Services for any illegal or unauthorized purpose;
your use will comply with all applicable laws and regulations.

If you provide information that is untrue, inaccurate, incomplete, or outdated, we have the right to suspend or terminate your account and refuse your current or future use of the Services.

4. User Registration

You need to register to use the Services. You agree to keep your password confidential and are responsible for all activities under your account. We reserve the right to remove, reclaim, or change a username we deem inappropriate, vulgar, or otherwise objectionable.

5. Product Information

We endeavor to accurately display the colors, features, specifications, and details of products on the Services. However, due to electronic display limitations, we do not warrant that the colors, features, specifications, and details displayed will be visually identical to the actual products, and your electronic display device may not accurately reflect the actual colors and details. All products are subject to availability, and we reserve the right to discontinue any product at any time. Product prices are subject to change, and we will notify you through reasonable means.

6. Purchases and Payment

This Website is a product display and information service platform and does not currently support direct online purchases and payment transactions. If you wish to purchase IQAir products, please do so through our authorized official online sales channels or offline authorized distributors. If you purchase through the above third‑party channels, the relevant transaction will be governed by the payment terms and rules of that channel, and the provisions of these Terms of Use regarding purchase, payment, returns, and warranty shall apply only to the extent that the relevant channel rules do not provide otherwise.

7. Subscription Services

Subscriptions are not automatically renewed. If changes occur, we will notify you in advance in accordance with applicable laws.

8. Returns, Refunds, and Warranty

IQAir China's domestic official online sales channels (excluding Hong Kong, Macao, and Taiwan) support a 7‑day unconditional return policy. If you are not satisfied with the product after receiving it, you may apply for a return within 7 days from the date of signing for receipt, provided that the product remains in a condition that does not affect its resale, and the return shipping cost shall be borne by you. [We expressly state: because purifiers and filters are imported products in their original packaging, once the filter shrink‑wrap is unsealed, it will affect resale; once the purifier is powered on and used, it will affect resale; in such cases, the 7‑day unconditional return policy does not apply. If you intend to exercise your 7‑day unconditional return right after purchasing through official online sales channels, please keep the purifier's outer carton for at least 7 days after receipt and do not unseal the filter shrink‑wrap; otherwise, you may only return the product upon our separate consent, and you will be charged 15% of the total price as compensation for affecting the product's resale. Products purchased through IQAir China's official offline physical channels are not covered by the 7‑day unconditional return policy; returns and exchanges shall be handled in accordance with laws and regulations relating to product quality.]{.underline}

IQAir China's domestic official online sales channels (excluding Hong Kong, Macao, and Taiwan) offer a one‑year nationwide warranty for the main unit (excluding consumables such as filters), with the warranty period commencing from the date you sign for receipt of the product. For residential customers, during the warranty period, if the purifier main unit experiences a malfunction due to normal use, IQAir will provide free repair services. In cities with service centers, free door‑to‑door pick‑up and repair services are available. If you are not located in a city with a service center or are outside the free pick‑up and delivery range, you will need to mail the machine to the nearest IQAir office for free repair, with shipping costs borne by IQAir. Repairs for the AirVisual Pro series products are handled exclusively via courier. However, malfunctions and damage caused by human factors, as well as filters (which are consumables), are not covered by the warranty.

The warranty policy described in this section is a general description. The specific scope, duration, and exclusions of the warranty shall be governed by the warranty card, product manual, or online platform detail page accompanying the product at the time of purchase.

If you encounter after‑sales or installation issues, you may call 400‑108‑5117 or seek online assistance through the Website. For products beyond the warranty period, we may still provide paid repair services, with specific fees determined based on inspection results.

9. Prohibited Activities

You shall not use the Services for any purpose other than those expressly provided by us. Without our express consent, the Services may not be used for any commercial activity.

As a user, you agree not to:

systematically retrieve data or content to build a database or compilation without our written consent;
deceive or mislead us and other users, or attempt to obtain sensitive account information;
circumvent or interfere with security features;
disparage, damage us and/or our brand reputation and/or the Services;
use information obtained to harass, abuse, or harm others;
improperly use support services or submit false reports;
use the Services in a manner that violates laws or regulations;
build deep links or framed links without authorization;
upload viruses, trojans, malicious code, or engage in interfering operations;
use any automated means (such as data mining, robots, crawlers, etc.) to extract data;
remove any copyright notices from any Content;
impersonate others or use another user's username;
upload any information collection or transmission mechanisms (such as pixel tags, web beacons, spyware, etc.);
interfere with or increase the burden on the Services, servers, or networks;
harass, intimidate, or threaten us and/or our employees;
attempt to bypass any access restrictions;
copy or adapt the software code of the Services, except as expressly permitted by law;
decompile, disassemble, or reverse engineer any software;
use any automated system to scrape or read the Services;
collect usernames or email addresses by electronic or other means to send spam;
use the Services for competitive purposes, or for any revenue‑generating or commercial activity;
use the Services for advertising or selling goods;
sell or transfer your account credentials.

10. Review Guidelines

We may permit you to post comments or reviews. When posting reviews, you shall comply with the following principles: reviews must be based on personal experience, must not contain offensive or discriminatory language, must not involve illegal activities, must not be manipulated by competitors, must not contain false or misleading statements, and must not organize malicious review campaigns, etc. We reserve the right to accept, reject, or remove reviews in our sole discretion. You grant us a worldwide, perpetual, free, sub‑licensable right to use review‑related content (provided that if the review contains your personal information, such license shall continue until you request deletion of such content in accordance with the Privacy Policy). Reviews represent only the personal views of the users.

11. Third‑Party Websites and Content

The Services may contain links to third‑party websites or content. We do not investigate, monitor, or make any warranties as to the accuracy, completeness, legality, or appropriateness of such third‑party websites or content. Your access to such links or use of third‑party content is at your own risk. You should review the terms of use and privacy policies of the relevant websites. Transactions between you and third parties occur solely between you and the third party, and we are not responsible for them.

12. Service Management

We reserve the right, but have no obligation, to monitor the Services for violations of these Terms, take legal action against unlawful conduct, restrict or remove content, manage system load, and otherwise protect our rights and property and ensure proper operation of the Services.

13. Privacy Policy

We value your data privacy and security. Please review our Privacy Policy. By using the Services, you agree that we may collect, use, store, and process your personal information in accordance with the Privacy Policy, which is an integral part of these Terms of Use.

14. Copyright Infringement Complaints

We respect the intellectual property rights of others. If you believe that any material on the Services infringes your copyright, please immediately notify us through the contact channels published on the Website and provide a notice that complies with legal requirements.

Please note: If you knowingly make a false statement in your infringement notice, you may be liable for damages.

15. Term and Termination

These Terms of Use remain in effect while you use the Services. We reserve the right, without notice and in our sole discretion, to deny access to or use of the Services, terminate accounts, and remove content for any reason, including violation of these Terms or applicable law. Upon termination, you may not re‑register in any manner. We reserve the right to pursue legal remedies.

16. Modifications and Interruptions

We reserve the right to change, modify, or delete the content of the Services at any time. For any modifications, price changes, suspensions, or interruptions, please refer to the updates and/or announcements on our official online store pages. We cannot guarantee that the web services will never be interrupted, and we are not responsible for any losses or inconveniences caused thereby. This disclaimer does not affect your non‑excludable statutory rights under applicable law.

17. Governing Law

These Terms of Use and your use of the Services are governed by and construed in accordance with the laws of the People's Republic of China, without regard to conflict of law principles.

18. Dispute Resolution

Friendly Negotiation
Any dispute arising out of these Terms of Use shall first be resolved through friendly negotiations between the parties in good faith, with the aim of resolving the dispute within 30 days.

Litigation Jurisdiction
If negotiation fails, either party may bring an action before the competent people's court in the defendant's domicile. If you are a consumer, you may also choose to bring an action before the court of your domicile, the place of contract performance, or any other place having a substantial connection with the dispute.

19. Error Corrections

The information in the Services may contain typographical errors, inaccuracies, or omissions, and we reserve the right to correct them at any time without prior notice.

20. Disclaimer of Warranties

The Services are provided "as is". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and similar matters. We do not warrant against unauthorized access to servers or information, service interruptions, virus transmission, or the like. We are not responsible for products or services promoted or linked by third parties.

Notwithstanding the foregoing, this disclaimer does not exclude or limit our liability for: (1) personal injury or death caused by our gross negligence or willful misconduct; (2) any other liability that cannot be excluded or limited under applicable law.

21. Limitation of Liability

In no event shall we or our officers, employees, or agents be liable to you or any third party for any indirect, incidental, or consequential damages arising out of the use of the Services, including lost profits, data loss, etc., even if we have been advised of the possibility of such damages. However, the foregoing limitations do not apply to types of damages that are prohibited by law from being limited.

In any event, our total liability to you (regardless of the form of action) shall not exceed the amount, if any, paid by you through the Services to us during the six (6) months preceding the event giving rise to the claim. If applicable Chinese law imposes mandatory provisions on specific types of liability, such provisions shall prevail.

22. Indemnification

You agree to indemnify, defend, and hold us harmless from and against any third‑party claims, losses, expenses (including reasonable attorneys' fees) arising out of your Submissions, your use of the Services, your violation of these Terms, your infringement of others' rights, or your intentional misconduct. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you shall cooperate accordingly.

23. User Data

We will maintain data transmitted by you to manage service performance and perform regular backups. However, you are solely responsible for all data you transmit, and we are not liable for any loss or corruption of such data, and you hereby waive any right to sue us for such data loss. This provision does not limit your statutory rights under the Personal Information Protection Law, including the right to access, copy, correct, and delete your personal information.

When you use IQAir connected devices, the devices transmit air quality data to IQAir by default and are set to private mode, accessible only to you and us. You may set your device to public mode to share data. You own your air quality data. By using the device, you agree that we may collect such data and grant us a non‑exclusive, transferable, sub‑licensable, royalty‑free worldwide license to store, use, publish, etc., such data in aggregated and anonymized form. The term of this license is the period during which you use the Services. After you cancel your account or withdraw consent, we will delete your personal information or anonymize it within a reasonable period. We will not use your air quality data for any purpose other than as set forth in these Terms, nor will we provide or sell your raw data to third parties.

24. Electronic Communications and Signatures

Accessing the Services, sending us emails, and filling out online forms constitute electronic communications. You consent to receive agreements, notices, etc., from us in electronic form and acknowledge that they satisfy any legal requirement that they be in writing. You agree to use electronic confirmations or electronic signatures and accept electronic records. However, this clause does not reduce your statutory rights as a consumer, including the right of withdrawal.

25. Language

These Terms of Use may be translated into other languages. In the event of any conflict between the Chinese version and any other language version, the Chinese version shall prevail.

26. Not Medical Advice

The Services and any IQAir products are not medical devices, do not provide medical advice, and are not intended to diagnose, treat, or prevent any disease. Health‑related information is provided for reference only. For medical needs, please consult a qualified physician.

27. Miscellaneous Provisions

These Terms of Use and any policies or rules we post constitute the entire agreement between the parties. Our failure to exercise or enforce any right or provision shall not constitute a waiver of such right or provision. If any provision of these Terms is found to be invalid or unenforceable, such invalidity or unenforceability shall not affect the validity of the remaining provisions. These Terms do not create a joint venture, partnership, employment, or agency relationship between the parties. You agree that these Terms shall not be construed against us by reason of having been drafted by us. You waive any right to challenge these Terms on the ground that they are in electronic form and not signed in writing. We reserve the right to assign our rights and obligations under these Terms. We are not liable for any loss, damage, delay, or failure to perform arising out of causes beyond our reasonable control.
